Q: Pregnancy Leave Laws

I know that a company which has 50 or more employees has to give u up to 3 months off work (unpaid or paid depending on their policy) and you can still return to your job after your leave.

BUT my question is...

What if you work somewhere where there are less than 50 employees? Are there any laws protecting me in my job security or am I going to have to find a new job after the baby is born? I have a good job with benefits and I really dont want to loose it but I also dont want to have to go back to work a week after he is born.

Would definetly look into The family Medcal Leave Act <FMLA> fr your state. Your doctor will help you file the paperwork when your baby is born. Good Luck!

I feel like any job, no matter the amount of employees, has Family Medical Leave Act, which is 12 weeks. You should be covered under that, but I can't say for sure with the number of employee's stipulation. So, look up FMLA laws and you should be able to find. I may be mistaken, but under law I believe all mothers get at least 6 weeks off as instructed my your doc. as "recovery time". That 6 weeks time should not matter on the number of employees.
